Tertiary Decree: 3 additional months of delay

On Thursday, September 22, the OPERAT platform was temporarily unavailable. Probably a victim of its own success – 8 days before the deadline for the first Tertiary Decree declaration – the situation was restored in the following hours.

On the same day, the Ministry of Ecological Transition nevertheless announced in a press release “a tolerance (…) granted until December 31, 2022 to complete its declarations”.

Taxable persons therefore now have until the end of the year to declare:

  • Their functional entities (i.e. the owner-tenant “pairs”, associated with the premises they own or occupy), called “EFA”
  • The annual consumption of each EFA for the years 2020 and 2021,
  • The annual reference consumption for these EFA (not mandatory but recommended in particular for the most energy-intensive buildings). In this regard, the press release specifies that this data may be provided/modified throughout 2023.

Back to basics

As a reminder, the Tertiary Decree, published in July 2019, requires all owners and tenants of tertiary premises of more than 1000 sqm to:

Declare each year on a platform operated by ADEME (OPERAT) all of their energy consumption. Taxable persons have until September 30 of year N+1 to declare consumption for year N. The year 2022 is therefore an exception to the rule.

Reduce energy consumption:

  • By 40% by 2030, 50% by 2040 and 60% by 2050, compared to an annual reference consumption (recorded between 2011 and 2019),
  • Or to reach a threshold in absolute value (of the order of 110kWh/sqm per year in 2030, for offices for example). This value will be easier to reach for buildings constructed in RT 2012 or RE2020.
