This is no news to anyone: the world of real estate is very energy-intensive. Institutions have also become aware of this problem and want to encourage real estate players to take action.
France has already done so by proposing the tertiary decree. The latter requires property owners to reduce their energy consumption by 2030.
Europe has also proposed to initiate a conversation on the subject through the BACS (Building Automation and Control System) decree. Directive 2010/31/EU requires Member States to transcribe this decree into their legislation.
Thus, the BACS decree is a new building block towards building more sustainable European real estate.
The objectives of the BACS decree
This decree is divided into 4 objectives in order to reduce the carbon impact of the sector:
- Monitor, record, analyze energy consumption by zones,
- Be interoperable with the different technical systems of the building,
- Situate the energy efficiency of the building in relation to reference values and detect losses of efficiency and notify the manager.
- Possibility of manually stopping and autonomously managing technical systems.
Unlike the tertiary decree, the BACS decree is rather focused on the means implemented and not so much on the results. This allows owners to equip themselves in the best possible way to achieve energy sobriety.
Currently, we support you in meeting the first three objectives by monitoring your consumption in real time. For management, you just need to have a BMS on your building to allow us to manage it thanks to our direct contact with the maintainer.
But soon, we will be able to remotely control your HVAC equipment and even automate settings to optimize the performance of your buildings. Our “PEPIT” R&D project, awarded by the i-nov competition, aims to achieve 8% additional energy savings on our existing solution.
Who is affected by this decree?
The decree affects both existing and new buildings.
Concerning existing buildings, these are impacted on different dates:
Buildings with a system with a nominal value greater than 290 kWh must comply with the regulations from January 1, 2025.
Those with a system with a nominal value greater than 70 kWh must comply with the regulations from January 1, 2027.
New buildings with a building permit filed from today with a system with a nominal value greater than 70 kWh are affected.
It should be noted that this obligation was made in two stages.
First, buildings with a building permit filed between July 21, 2021 and April 7, 2024 with a system with a nominal value greater than 290 kWh were affected.
Then, France changed the nominal value in order to be more in line with the tertiary decree. This change is applicable since April 8, 2024.
